Privacy policy
Last updated 25 September 2026.
Fitguard Australia (“Fitguard”, “we”, “us”) makes custom mouthguards and night guards. We respect your privacy and handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why, and how you can access or correct it.
What we collect
When you send an enquiry, book a fitting or buy from us, we may collect your name, phone number, email address, suburb or preferred clinic, the details of your enquiry, and for juniors the name of a parent or guardian. At a fitting we may also record information about your teeth and oral health, such as impressions, scans, braces or jaw symptoms. This is health information, and we only collect it with your consent and only to make and fit your guard.
Like most websites, our site may also record basic technical data such as your browser, device and the pages you visit, through cookies and analytics tools. This does not identify you by name.
How we collect it
Directly from you: through the enquiry form on this website, by phone, by email, through social media messages, or in person at a clinic or club fitting day. If a parent or guardian books for a child, we collect the child’s details from that parent or guardian.
How we use it
We use your information to respond to your enquiry, arrange and carry out your fitting, make your guard, process payment and health fund claims, contact you about your order or aftercare, and keep business records we are required to keep. We will not sell your personal information or use it for unrelated purposes without your consent. If we send you news or offers, you can opt out at any time.
Who we share it with
We only share what is needed with service providers who help us run the business:
- Our customer relationship system (CRM). Enquiries sent through this website are stored in our CRM so we can reply and manage bookings.
- Stripe. Online card payments are processed by Stripe. We never see or store your full card number.
- HICAPS and your health fund. If you claim on the spot, your membership and claim details are sent to your health fund through HICAPS.
- Professional advisers and authorities, such as our accountant, or where the law requires us to.
Some of these providers may store data on servers outside Australia. We choose providers that protect personal information to a standard comparable with the APPs.
How we keep it safe
We take reasonable steps to protect your information from misuse, loss and unauthorised access, including access controls on our systems and secure storage of paper records. We keep health and business records for as long as the law requires, then securely destroy or de-identify them.
Accessing or correcting your information
You can ask to see the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable time, usually 30 days. If we cannot give you access, we will explain why.
Questions and complaints
If you have a question or a complaint about how we have handled your information, please contact us first and we will try to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
